1) Contents of Terms of Use Terms

  • Subscriber – A person who is/has been on the website managed by Willpowerbrand (hereinafter referred to as WP) willpowerbrand.com and/or buys/consumes Products sold by the WP e-store. The subscriber can be on the website and/or in the e-shop and submits/cannot order when registering or registering a user.
  • Terms of use – Terms and conditions apply to e-shop/homepage guests, which are mandatory for all persons staying on the website and making purchases on the home pages.
  • Product, Products – Product(s) sold by WP e-shop.
  • WP – Legal entity that sells Products or Service in the WP e-store/website willpowerbrand.com.
  • Sales transaction – the contract regarding the purchase of the Product concluded between the Customer and WP through the e-shop/homepage.
  • Signs in the WP e-shop: * – the product will be excluded from the WP product range after the stock runs out.

2) general ordering conditions

  • The terms and conditions apply to legal relationships between all persons and the owner of the shopping environment willpowerbrand (hereinafter referred to as e-shop) (hereinafter referred to as WP) when purchasing products through the e-shop.
  • Furthermore, it is necessary to regulate the legal relations arising from the purchase of products through the WP e-shop by the legislation in force in the Republic of Estonia.
  • WP is justified due to the development of the e-store and the interests of better and safer use of the e-store. All transactions are subject to their current terms and conditions. Changes to the terms and price list and will take effect from the publication of the corresponding changes or additions on the website willpowerbrand.com/terms of use. If you submit your order before the terms come into force, the terms and conditions in effect at the time of your order submission apply to the legal relationship between you and the WP amendment, if the law or these terms and conditions provide for rights.

3) Registration procedure

  • The regular customer of the WP e-shop must be the Subscriber to register as a user of the internet environment at www.willpowerbrand.com
  • In order to register, it is necessary to fill in all the boxes marked with letters in the form.
  • After registration, WP sends a letter to the e-mail address specified by the Subscriber confirming that he has created an account in the WP e-shop.
  • After activating the user account, the Subscriber can enter the WP internet environment with the user ID and password specified by him and place orders for products under his account.
  • When registering as a user of the WP e-store, the customer can pre-save his contact details and view his previous orders afterwards.

4) Procedure for ordering products

  • To order products, the Customer does not need to register as a WP e-shop user.
  • Description of the purchase process: The customer selects the Product(s) and determines the quantity of each Product. Once the products have been selected, the Customer moves to the shopping cart and selects the method of delivery of the Products. The subscriber moves forward on the page by pressing the “FORM ORDER” button. the order is filled by the Customer according to the choice of the delivery method. The customer chooses the method of payment for the Products and confirms that he has read the terms of use. The customer confirms the order by pressing the “I ORDER WITH PAYMENT OBLIGATION” button and makes the payment through the selected bank. After making the payment, you must press the “Back to the merchant” button in the bank, otherwise the order will not be delivered.
  • All product prices in the e-shop are in euros and do not include shipping costs and include VAT 20%.
  • The price of the ordered Products includes the delivery fee of the Products according to the delivery methods chosen by the Customer (the payment confirmed by the Customer can be made in WP using the internet bank link or with a credit card (VISA or Mastercard).
  • The order is formalized and delivered in case of 100% advance payment. WP informs the Customer about the dispatch of the products and the consequent entry into force of the order via e-mail.
  • A document of the conditions of use in pdf format and a standard return application form in pdf format are added to the order confirmation sent to the customer via e-mail. The order invoice (with the order details and other information) to the customer together with the product (NB! WP RECOMMENDS that the customer keep the invoice, so that in the future it is possible to solve claims easier and faster).

5) Delivery of Products

  • Ordered Products will be delivered by WP to the Customer in accordance with the Customer’s order in the manner selected by: Itella SmartPost
  • In the event that the delivery of the Product is not possible, i.e. if there are problems or on shortage of goods, WP is obliged to immediately inform the Customer about a possible longer delivery period of the Product via the contact phone number or e-mail indicated when placing the order within 2 working days from the order taking effect. If the Subscriber accepts this, WP will continue to fulfill the Order. In the event that the Customer loses interest in purchasing the Product due to a longer deadline for the delivery of the Product, the Customer has the right to cancel his order (see point 8 for more details) and the amount paid by the Customer (including the cost of transportation) will be returned to the Customer.

6) Delivery time of products

  • The courier will deliver the Product to the address indicated by you in 1-3 working days, but no later than within 4 working days after placing the order. Before delivery, you will be contacted to arrange a suitable delivery time.
  • Itella Smart POST will deliver the Product(s) to the parcel machine chosen by the Customer within Estonia on the next working day if the order is completed on a working day between 9:00 and 15:00. When the order arrives at the parcel machine, a message is sent to the Customer’s mobile phone, which contains the location of the parcel machine, opening hours and personal door code. When entering the code on the touch screen of the parcel machine, the door of the parcel machine opens and the Customer receives the package. Shipments are stored free of charge in the SmartPost parcel machine for 7 calendar days, from when the message is sent to the Subscriber’s mobile phone and/or e-mail address.If it turns out that it is not possible to pick up the package by the deadline, it is possible to extend the storage time of the package by calling the SmartPost service phone and stating the door code and the day when it is possible to pick up the package. If the Customer has not tracked the package within 7 calendar days, the order is subject to cancellation, and the amount paid for the order (from which the costs of returning the goods have been deducted) will be returned to the Customer’s current account within 14 calendar days at the latest. Free delivery from order 30.-
  • We deliver the goods to the islands within 1-3 working days.

7) Ordering and Delivery outside the Republic of Estonia

  • WP offers the possibility to order Products outside the Republic of Estonia. The customer pays the postage.

8) Consumer’s right to withdraw from the order

  • The customer has the right to withdraw from the order for the Products within 14 calendar days from the time the order is placed until receiving the Products.The 14-calendar-day right of return does not apply to products whose recommended use-by date is quickly reached. The right of return does not apply to products whose packaging has been opened or damaged. To withdraw from the order, the Subscriber must submit a statement to WP or e-mail willpowerbrand@gmail.com using either the standard withdrawal form (which is sent to the Subscriber’s e-mail after the order has entered into force) or by submitting another unequivocal withdrawal statement within the 14 calendar days under the right of withdrawal.</li >
  • In the written statement of withdrawal from the order, the Subscriber must indicate the bank account number and the name of the bank account holder, where the returned money should be transferred. Cash refunds are not made by WP.
  • In the event that the customer withdraws from the order, the customer undertakes to return the unused and undamaged Products in their original packaging (the original packaging may be opened, but must not be damaged in any other way) without delay, but no later than within 14 calendar days from the date of sending the withdrawal request.
  • WP will return to the Customer the amount paid for the order (from which the costs of returning the goods have been deducted) within 14 calendar days of receiving the cancellation notice at the latest, provided that the Customer has also returned the Products by that time. WP also refunds the shipping costs to the Customer if the reason for the withdrawal is a defective Product.
  • In case of deterioration of the product to be returned, the Customer is responsible for the decrease in value due to the use of the product only if he has used the product in a way other than what is necessary to make sure of the product’s nature, properties and functioning. In order to make sure of the nature, properties and functioning of the product, the Customer should handle and use the product only as he would normally be allowed to do in the store. In the event that the Product returned by the Customer has deteriorated, WP has the right to demand compensation in the amount up to the selling price of the Product, depending on the decrease in the Product’s value. The said amount is deducted from the amount returned to the Customer.
  • WP is not responsible for damage to the Product caused by the Customer; for defects caused by non-intended use of the Product; For natural physical wear and tear of the Product during normal use of the Product; Using the product under conditions or in a manner that can be expected to wear faster than usual; in other cases provided by law.
  • The customer who chose Itella SmartPost as the product delivery method has the option to return the product to WP via SmartPost within 14 calendar days. The product can be returned from the same door at SmartPOST parcel machines located all over Estonia with the ecode that was on hand. Accordingly, WP advises the Subscriber to keep the door code SMS message received by Itella SmartPost until the end of the 14 calendar day return period. Upon receipt of the product, WP will return the amount paid for the order to the Customer, minus the costs associated with returning the product. If the return of the product is related to the fact that the product is defective, the costs related to the return of the product will be borne by WP.
  • 9) Subscriber’s rights and submission of claims
  • The customer has the right to order Products in the e-store at the price set by WP and under fixed conditions.
  • The Product sent to the customer must be correct and complete and meet the conditions set by WP.
  • The customer has the right to submit product-related claims to WP to the e-mail address: willpowerbrand@gmail.com within 2 years from the receipt of the Product, but no later than 2 months from the appearance of the defect. In the claim statement, the Customer must indicate the following information: Name and contact information, Date of filing the complaint, Description of the defect and/or lack of the product; if possible, add photos, if possible also the number of the invoice (which the Customer received with the goods).
  • If repairing or replacing the Product is not possible, the Customer has the right to withdraw from the sales transaction and return the Product to WP. WP undertakes to return the purchase amount paid on the basis of the sales transaction and the costs related to the return within 14 calendar days from the receipt of the reasoned statement of withdrawal.
  • The customer has the right to cancel the order for Products in accordance with clause 8.
  • 10) Obligations of the customer
  • According to the choice of transport method, the Customer fills in the necessary cells marked with an asterisk when placing the order.The customer is obliged to provide the data necessary to execute the order and to make sure that they are correct.
  • If the information provided by the Customer is incorrect and/or incomplete, WP does not guarantee the proper fulfillment of the Product order. If possible, WP will contact the Subscriber to clarify incorrect or incomplete data.
  • When completing the order, the Customer confirms that he agrees with the conditions set out in the WP e-store terms of use and undertakes to comply with them.
  • The customer is obliged to pay for the goods and accept them in accordance with the procedure stipulated in these terms of use.
  • The customer, who makes a purchase from this e-shop, undertakes to adhere to these terms of use and other conditions that are presented in this e-shop and the legislation of the Republic of Estonia.
  • 11) WP obligations
  • WP undertakes to deliver correct and complete Product(s) to the Customer.
  • WP undertakes to accept and document all claims of the Subscriber.
  • WP undertakes to resolve the Customer’s claim within 15 calendar days if the reasons for the claim are not dependent on the Customer. If the reason for the claim is caused by the Customer, the Customer must eliminate it immediately.
  • WP undertakes to repair/replace scrap copies of the Products. WP is only responsible for manufacturing errors and other defects that existed when the Product was handed over to the Customer.   • 12) Protection of personal data, Privacy Policy
  • All personal data of the customer that became known during the visit of the WP e-store and making purchases are treated as confidential information.
  • The encrypted data communication channel with the banks ensures the security of the purchaser’s personal data and bank details.All responsibility for these personal data rests with the bank whose services are used by the Subscriber.
  • WP confirms that the personal data entered by the Subscriber will only be processed when purchasing goods from the WP e-store and for marketing purposes (unless the Subscriber does not wish to receive a monthly newsletter or cancels this option later) and direct marketing (in the event that the Subscriber does not wish that his e-mail or phone number is used for direct marketing purposes, must inform WP). WP undertakes not to disclose the Customer’s personal data to third parties, except for WP’s partners who provide goods delivery or other services related to the proper fulfillment of the Customer’s order. In all other cases, the Subscriber’s personal data may be disclosed to third parties only in accordance with the procedure provided for in the legislation of the Republic of Estonia. WP collects phone numbers, names and emails.
  • In order for the Subscriber to be able to make purchases in a full-fledged e-store, WP enters information – “cookies” – into the Subscriber’s computer (device). The entered information is used by WP Tellija to identify the Customer as a former visitor of the e-store, to store information about the goods placed in the shopping cart, to collect data about website visits, etc. The Subscriber has the opportunity to review what information (“cookies”) has been entered by WP, and the Subscriber can delete some or all of the entered “cookies”. The customer has the same i right not to accept that information (“cookies”) are entered and used on his computer (device), but in this case certain functions of the e-store may be unavailable to the Subscriber. By accepting these conditions, the subscriber agrees that information is entered into his computer (device). This consent can be revoked by the Subscriber at any time by changing his browser settings.
  • WP is the responsible processor of personal data, WP transmits the personal data necessary for making payments to the authorized employee Maksekeskus AS.
  • 13) Force Majeure

     a WP is not responsible for damages caused to you or for delays in product delivery if the damage or delay in product delivery is due to a circumstance beyond WP’s control and the occurrence of which WP could not foresee or foresee (force majeure ).

  • WP is not responsible for late delivery of the goods, if the product or products are not delivered or are not delivered on time due to the Customer’s fault or due to circumstances beyond the Customer’s control.
  • 14) Disclaimer
  • Pictures and videos are for illustrative purposes (NB! The information in the product description is always more correct than the information that the Customer can see in the pictures).
  • Product data and information are regularly updated. Due to the inadequacy of manufacturers’ data cards, there may be inaccuracies in the product information of the WP e-shop. In this case, the WP e-shop does not take responsibility for the correctness of the product data. The product information may have been updated since the last visit.   • WP is released from any responsibility in cases where damage occurs because the Subscriber, ignoring WP’s recommendations and his own obligations, did not familiarize himself with these terms of use despite the fact that the Subscriber was given the opportunity.
  • WP reserves the right to cancel the sale if any of the following problems have occurred with the Product: there has been a human error when entering the price or a technical error in the system (for example, if a Product costing €20 is suddenly on sale for €1, it is clearly an error. Consequently, we assume, that the Customer should understand that it is a mistake and the Product is not for sale at such a price).
  • If the prices in the e-store have been changed after the Customer has placed an order and paid for it, WP undertakes to deliver the corresponding products to the user at the prices valid at the time of the order. The user of the service does not have the right to demand compensation for the price difference.
  • 15) Final Provisions
  • These regulations have been drawn up based on the legislation of the Republic of Estonia.
  • Issues not resolved separately in these terms of use are based on the legislation in force in the Republic of Estonia.
  • Arising disputes between the Customer and WP, ​​in connection with the ordering and purchase of products through the WP e-store, will be resolved through negotiations. If no agreement is reached, the Customer has the right to apply for the protection of his rights through the Consumer Protection Board of the Consumer Complaints Commission or to the court. The details of the Consumer Complaints Commission are provided on the website of the Consumer Protection Board (http://www.tarbijakaitseamet.ee/et/kontakt). The Consumer Complaints Commission is competent to resolve disputes arising from the contract concluded between the consumer and the trader, which the parties have not been able to resolve by agreement and if the value of the goods or services in dispute is 20 or more euros. Review of the complaint by the Consumer Complaints Commission is free of charge for the parties.
